1. Purpose
These Terms of Use (hereinafter "Terms") govern access to and use of the Realty Invest platform (hereinafter "the Platform"), available at [URL_SITE]. By accessing the Platform or creating an account, you unconditionally accept these Terms. If you do not accept these Terms, you must cease all use of the Platform.
2. Definitions
• "User": any natural or legal person accessing the Platform, whether or not they have an account. • "Individual": a user registered as a non-professional natural person. • "Professional" (or "Pro"): a user registered as a real estate agent, developer or company. • "Listing": any offer for the sale or rental of a property published on the Platform. • "Lead": a contact request sent by a User to an advertiser via the Platform's contact form. • "Content": any text, image, photograph or data published on the Platform by a User.
3. Registration and User Account
Registration is free and requires a valid email address. The User undertakes to provide accurate and up-to-date information. Each User is responsible for the confidentiality of their login credentials. Any activity carried out from their account is deemed to have been performed by them. Professional accounts are subject to a verification process. Realty Invest reserves the right to refuse or suspend a professional account if the documents provided are insufficient or fraudulent. Realty Invest reserves the right to suspend or delete any account in the event of a breach of these Terms.
4. Plans and Subscriptions
The Platform offers different plans with specific limits: • Free plan (Individual and Pro Free): limited to 1 active listing, 3 photos per listing, 1 search alert. • Standard plan: limited to 5 active listings, 10 photos per listing, 20 alerts. • Premium plan: limited to 15 active listings, 20 photos per listing, 20 alerts. • Unlimited plan: unlimited listings, 20 photos per listing, 20 alerts. Paid plans may include a free trial period. Upon expiration of the trial period, the User must subscribe to retain the plan's features. Current prices are displayed on the Platform's subscription page. Add-ons may be purchased separately to increase photo or active listing limits.
5. Listing Publication
The User undertakes to publish only listings for real properties for which they are the owner, authorised agent or duly mandated representative. The following are prohibited: • Misleading, deceptive or fictitious property listings. • Discriminatory, defamatory, unlawful or content contrary to public policy. • Publishing personal contact details (phone, email) in the listing body to circumvent the contact system. • Deliberate duplication of identical listings. All submitted listings are subject to moderation before publication. Realty Invest reserves the right to refuse, modify or remove any listing that does not comply with these Terms. Despite the automated and human controls in place (pre-publication moderation, verification of professional accounts, handling of reports), Realty Invest cannot guarantee the complete absence of fraudulent or inaccurate listings on the Platform. Users are invited to exercise vigilance: verify the identity of their counterparty, physically visit the property before making any payment, and never share banking information via the contact form. Any listing suspected of being fraudulent can be reported to [EMAIL_CONTACT]. Individual listings automatically expire after 60 days. Paid plan listings do not expire as long as the subscription remains active.
6. Contact and Leads
The Platform allows Users interested in a property to send a message to the advertiser via a contact form. Realty Invest acts as a technical intermediary and does not participate in exchanges or transactions between Users. The Platform does not guarantee the availability, accuracy or quality of the listed properties. A User sending a lead undertakes not to use the contact form for spam, harassment or unsolicited commercial solicitation. When exchanging messages, Users agree never to share sensitive information such as: banking details (IBAN, card number, CVV), passwords, confirmation codes, copies of identification documents, social security numbers, or any other personal data that could expose the User to fraud. Realty Invest will never request such information through the messaging system and will never take part in a financial transaction between Users.
7. Intellectual Property
The Platform, its design, features, source code and all its constituent elements are the exclusive property of Realty Invest and are protected by intellectual property law. The User retains intellectual property rights over content they publish (text, photos). By publishing content on the Platform, the User grants Realty Invest a non-exclusive, free, worldwide licence to use, reproduce and display such content for the operation of the Platform. Any unauthorised reproduction, copying or use of Platform elements is strictly prohibited.
8. Limitation of Liability
Realty Invest endeavours to ensure the availability and proper functioning of the Platform but does not guarantee permanent accessibility or the absence of errors. Realty Invest shall not be held liable for: • Content published by Users, including listings and messages. • Transactions carried out between Users outside the Platform. • Fraud, scams or financial losses arising from transactions concluded between Users, Realty Invest being only a technical intermediary without any involvement in transactions. • Damages resulting from temporary unavailability of the Platform. • Any loss related to the use or inability to use the Platform. The User is solely responsible for their use of the Platform and the information they publish on it.
9. Personal Data Protection
The processing of personal data is governed by our Privacy Policy, accessible from the Platform. Realty Invest undertakes to comply with the General Data Protection Regulation (GDPR) and Cape Verdean Law No. 133/V/2001 on the protection of personal data.
10. Suspension and Termination
The User may delete their account at any time from their profile settings. Realty Invest reserves the right to suspend or delete an account, without notice or compensation, in the event of: • Breach of these Terms. • Publication of unlawful or fraudulent content. • Misuse of the Platform. • Non-payment of a due subscription. In the event of suspension or deletion, the User loses access to their listings and associated data, subject to legal retention obligations.
11. Applicable Law and Jurisdiction
These Terms are governed by the law of the Republic of Cape Verde and, where applicable, by French law for Users residing in France. In the event of a dispute, the parties undertake to seek an amicable resolution. Failing that, the competent courts shall be those of the registered office of Realty Invest or, for consumers residing in the European Union, those of the consumer's domicile in accordance with Regulation (EU) No 1215/2012.
12. Changes to These Terms
Realty Invest reserves the right to modify these Terms at any time. Changes take effect upon publication on the Platform. In the event of a substantial change, registered Users will be notified by email. Continued use of the Platform after a change constitutes acceptance of the new Terms. The last updated date at the top of this page shall prevail.
